All the Romanian employers are obliged to initiate collective bargaining starting on Monday, November 20


By the Government Emergency Ordinance no. 79/2017, the Romanian Government implemented the measure of transferring most social contributions from the employers to the employees. Thus, starting 1st of January 2018, the number of social contributions will drop from 6 to 3, their total value will be cut from 39.25% to 37.5% of the gross wage, and the most part, namely 35%, will be paid by the employees. This transfer of social contributions generates a decrease in the employees’ revenues by 16,6 %.

At the same Government meeting, on November 8, another measure was silently passed: the obligation for all the Romanian employers to initiate collective bargaining in order to „implement the measures taken in accordance with the Government Emergency Ordinance no. 79/2017”.

The Emergency Ordinance no. 82/2017, published in the Official Gazette on November 16, extends to all the employers the obligation to negotiate collective bargaining agreements, even if, in accordance with the general rule, only the employers having more than 20 employees are obliged to such negotiations.

Moreover, the trade union federations and confederations are granted with extended rights to negotiate collective bargaining agreements.
